Aucburg Online Auction Service Agreement

1. Introduction

1.1. This Agreement (hereinafter referred to as the "Agreement") governs the relationship between the Aucburg online auction (hereinafter referred to as the "Platform") and the User (hereinafter referred to as the "User") – an individual, legal entity, or sole proprietor registered according to the laws of the lot's country, using the Platform's services.

1.2. The Platform provides the User with the ability to list lots, participate in auctions, conclude deals, and interact with other Users.

1.3. The Platform is not a party to transactions between Users and is not responsible for their execution.

1.4. Terms Used:

  • Lot – A product or service listed by the User for sale or purchase.
  • Auction – The bidding process organized on the Platform.
  • User – A registered participant of the Platform.
  • Deal – An agreement between Users for the purchase and sale of a lot.

2. Registration and Access

2.1. To use the Platform's services, the User must register by providing truthful data.

2.2. Use of the Platform is permitted only to persons over 18 years old or those who have reached the age of legal capacity according to the laws of the lot's country.

2.3. The Platform reserves the right to request documents verifying the User's identity for verification purposes.

2.4. The User is responsible for maintaining the confidentiality of their account credentials and agrees to immediately notify the Platform in case of loss or unauthorized access.

3. Platform Services

3.1. The Platform provides:

  • Free registration and access to basic functions.
  • The ability to list lots and participate in auctions.
  • Tools for communication between Users.

3.2. Paid Services:

  • Lot promotion — increasing the visibility of lots on the Platform.
  • Subscription Tiers:
    • STANDARD (free): Listing lots and participating in auctions.
    • PRO: Priority display of lots, advanced analytical tools.
    • AUCTION HOUSE: Maximum visibility, individual support, additional advertising opportunities.

3.3. The Platform reserves the right to introduce new paid services, notifying Users 14 days before they take effect.

4. User Rights and Obligations

4.1. The User has the right to:

  • List lots and participate in auctions.
  • Leave reviews and comments about other Users.
  • Use the Platform's paid services.

4.2. The User undertakes to:

  • Comply with the terms of this Agreement and the applicable legislation of the lot's country.
  • Provide only truthful information about the lots.
  • Not publish prohibited goods and services (weapons, drugs, counterfeits, etc.).
  • Not use automated means to interact with the Platform.
  • Not transfer their account to third parties.

5. Platform Rights and Obligations

5.1. The Platform has the right to:

  • Moderate and remove lots that violate the terms of the Agreement.
  • Block or restrict User access in case of violations.
  • Implement a rating system based on reviews.

5.2. The Platform undertakes to:

  • Ensure access to the Platform's services.
  • Protect Users' personal data.
  • Notify Users of changes to the Agreement 14 days in advance.

6. Confidentiality

6.1. The Platform undertakes not to disclose Users' personal data, except in cases provided for by law.

6.2. The Platform collects:

  • Personal data provided during registration.
  • Information about deals and lots.
  • Technical data (IP address, cookies).

6.3. The User undertakes not to transfer account login details to third parties.

7. Liability of the Parties

7.1. The User is responsible for:

  • The accuracy of information about the lots.
  • Fulfilling obligations towards other Users.

7.2. The Platform is not responsible for:

  • The quality of goods and services listed on the Platform.
  • The actions of Users, including non-fulfillment of deals.
  • Technical failures caused by force majeure circumstances.

8. Disputes and Disagreements

8.1. Disputes between Users shall be resolved through negotiation.

8.2. If a dispute cannot be resolved, it shall be referred to the court at the Platform's location.

9. Changes to the Agreement

9.1. The Platform has the right to amend the Agreement, notifying Users 14 days in advance.

9.2. Continued use of the Platform after changes constitutes acceptance of the new version of the Agreement.

10. Termination of the Agreement

10.1. The User has the right to terminate the Agreement by notifying the Platform 30 calendar days in advance.

10.2. The Platform has the right to terminate the User's access in case of violations of the Agreement's terms.

11. Final Provisions

11.1. This Agreement is governed by the legislation of the lot's country.

11.2. All communications with the Platform administration should be sent via the contact form on the Aucburg website.
